You are a member of the Class if you used a credit or debit card at any Olan Mills Portrait Studios location between February 15, 2007, and December 31, 2012 and received a printed receipt containing more than the last five digits of the credit or debit account number and/or the card's expiration date.

Summary of the Class Action Lawsuit

The class action lawsuit, filed on June 20, 2012 alleged that Lifetouch Portrait Studios Inc. ("Lifetouch"), which now owns and operates studios previously owned by Olan Mills, Inc. ("Olan Mills"), violated certain requirements imposed by the Fair and Accurate Credit Transactions Act ("FACTA").  Specifically, that customers received printed receipts showing more than the last five digits of its customers' credit or debit card numbers in violation of FACTA. 

Defendants Lifetouch and Olan Mills dispute Plaintiff’s claims.  The Court has not decided in favor of Plaintiff of Defendants.  Instead, both sides have agreed to a settlement and that way, they avoid the cost of a trial and the people who are entitled will receive compensation.  The Class Representative and Class Counsel believe that the settlement is fair and reasonable.

 What Are the Settlement Benefits?


Class Members will be entitled to receive a coupon for a Portrait Package that will include a portrait sitting and 

choice of 3 electronic images on CD with full personal usage and reproduction rights ($75.00 retail value).  

The Coupon may be redeemed at any Olan Mills Portrait Studio or Lifetouch-operated studio within various 

department store locations.

coupons.  

The Coupon is non-redeemable for cash and non-transferrable except to your Immediate Family Members 

(your spouse, parents, children, brothers, or sisters (including those related by marriage)).  You will not be 

required to do any further business or make any additional purchases to use the Coupon.  You will be entitled 

to receive one Coupon for each Qualifying Transaction (a purchase with a credit or debit card in which you 

received a printed receipt containing more than the last five digits of the card number and/or the card's 

expiration date between February 15, 2007 and December 31, 2012).  The Court has approved the settlement 

and the Coupon will be effective from January 2, 2014 through July 1, 2014. 

 

Your Rights And Options


You may choose to participate in the proposed settlement or exclude yourself from it.

Choose to Participate - If you received an email notice or a postcard notice in the mail, you have been identified as someone who may have received a receipt that included more than the last five digits of your credit or debit card numbers and/or expiration date.  To receive the Portrait Package Coupon under the proposed settlement, you do not need to take any further action.  If the settlement is approved by the court, you can use the coupon code included with the notice at eligible Olan Mills Portrait Studios or Lifetouch-operated studios from January 2, 2014, through July 1, 2014.   Click the “Locations near you accepting coupons” link on the left to find locations near you that will accept your coupons.   The deadline to submit a claim form has passed
Exclude Yourself - The deadline to exclude yourself has passed.  
Object To The Proposed Settlement - The Court has approved the Settlement and the deadline to object has passed.
